If we cancel a paid order, we will process the applicable refund using the original payment method or another lawful method, subject to the processing timelines of banks, payment gateways, and service providers.

We do not guarantee that any product is free from allergens unless expressly stated on the final product label.
Product claims such as “all-natural,” “no refined sugar,” “no added refined sugar,” “high protein,” “good source of fiber,” “plant-based,” “gluten-free,” “keto-friendly,” “Halal,” or similar claims shall be understood based on the specific product label, ingredient composition, applicable standards, and final approved packaging.
To the fullest extent permitted by law, you agree that your purchase and consumption of our products are at your own discretion and responsibility.
SECTION 7 - FOOD SAFETY, ALLERGENS, AND PRODUCT-RELATED CLAIMS
MOOD FOOD takes food safety seriously and uses reasonable care in the manufacturing, handling, packing, storage, and distribution of its products in accordance with applicable food safety laws, regulations, and standards.
However, food products may be affected by factors outside our control after they leave our custody, including but not limited to courier handling, delivery delays, heat exposure, moisture exposure, improper storage, tampering, contamination after opening, customer mishandling, transfer to another container, resale, repacking, unauthorized modification, expired consumption, or consumption contrary to label instructions.
To the fullest extent permitted by law, MOOD FOOD shall not be liable for any injury, illness, allergic reaction, foodborne illness, contamination, spoilage, quality issue, or adverse reaction caused by:
a. Improper storage, handling, transport, preparation, or consumption after delivery;
b. Exposure to heat, moisture, pests, sunlight, unsanitary conditions, or foreign substances after the product leaves our custody;
c. Tampering, opening, resealing, repacking, relabeling, resale, or alteration by any person other than MOOD FOOD;
d. Consumption after the expiry date or contrary to product label instructions;
e. Consumption by persons with allergies, medical conditions, dietary restrictions, food sensitivities, or intolerances where such risk was known or should have been checked by the customer;
f. Failure to read the product label, ingredients, allergen information, storage instructions, or expiry date before consumption;
g. Acts or omissions of couriers, logistics providers, marketplaces, resellers, retailers, distributors, storage providers, fulfillment providers, or other third parties outside our reasonable control; or
h. Any claim that is unsupported by credible proof, product batch information, medical documentation where applicable, photos, videos, remaining product sample, packaging, or other evidence reasonably required for investigation.
Customers must inspect products upon receipt and immediately report any suspected safety, quality, contamination, allergen, or product defect concern to us at hello@moodfood.co. The customer must preserve the product, packaging, batch code, expiry date, delivery packaging, receipt, and any unused portion for investigation.
Where a food safety concern is reported, MOOD FOOD may require the return of the product, supporting photos or videos, medical documentation, laboratory test results, batch details, delivery information, and other relevant evidence. Failure to preserve the product or provide sufficient evidence may limit or prevent our ability to investigate or approve any remedy.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability arising from our proven gross negligence, willful misconduct, or sale of products proven to be unsafe, contaminated, adulterated, misbranded, expired, or nonconforming at the time they left our custody.
To the fullest extent permitted by law, our liability for any proven product-related claim shall be limited to the remedies required by applicable law and, where legally allowed, shall not exceed the amount actually paid for the specific product or order giving rise to the claim.
SECTION 8 - SHELF LIFE, STORAGE, DELIVERY, AND RISK OF PRODUCT CONDITION
Our products must be stored and handled according to the storage instructions on the product label or packaging. Exposure to heat, moisture, sunlight, pests, improper storage, mishandling, tampering, or delayed receipt may affect product quality.
Once an order is shipped or handed to a logistics provider, courier, rider, marketplace, fulfillment provider, or delivery partner, delivery timelines and handling may be affected by third parties, weather, traffic, failed delivery attempts, customer availability, force majeure, or other factors beyond our control.
Risk of delay, failed delivery, damage, deterioration, or loss caused by incorrect customer information, customer unavailability, refusal to accept delivery, delayed pickup, unauthorized recipient acceptance, or mishandling after delivery shall be borne by the customer, to the extent permitted by law.
You agree to inspect your order immediately upon receipt. Any concern involving missing items, damaged packaging, wrong item, quality issue, or suspected defect must be reported to us within a reasonable period and supported by clear photos, videos, batch information, order number, delivery information, and other evidence we may reasonably request.
Failure to provide sufficient proof may affect our ability to investigate or approve a remedy.
SECTION 9 - RETURNS, REFUNDS, REPLACEMENTS, AND CUSTOMER REMEDIES
Returns, refunds, replacements, cancellations, and related remedies are governed by our Return and Refund Policy, these Terms, applicable laws, and the rules of the payment or selling platform used for the transaction.
Because our products are food items, we may reject returns, refunds, or replacements for reasons including but not limited to change of mind, taste preference, customer ordering error, improper storage, delayed receipt due to customer unavailability, consumed products, opened products without valid quality concern, or issues not attributable to us, to the extent permitted by law.
Nothing in these Terms limits rights that consumers may have under applicable Philippine law for defective, unsafe, misdescribed, expired, damaged, incomplete, or nonconforming goods.
When a refund, replacement, or other remedy is requested, we may require the customer to return the original product, packaging, unused portion, photos, videos, batch code, order details, and other supporting evidence needed for verification, investigation, quality control, courier claims, or compliance purposes.
Where permitted by law, we may withhold approval of a refund or replacement until we receive and inspect the product or receive sufficient proof of the issue.
Approved refunds will generally be processed through the original payment method or another method we determine to be appropriate. Processing times depend on banks, payment providers, Shopify, couriers, and other third parties, and we are not responsible for delays caused by them.
Shipping fees, handling fees, payment processing fees, discounts, vouchers, or other charges may be non-refundable unless required by law or expressly approved by us.
We reserve the right to reject abusive, fraudulent, excessive, unsupported, inconsistent, or bad-faith refund, return, replacement, or chargeback requests.
SECTION 10 - PAYMENT, CHARGEBACKS, AND FRAUD
You agree to pay all amounts due for orders placed using your account, device, payment method, or information.
You represent and warrant that you are authorized to use the payment method provided.
We reserve the right to conduct fraud checks, request additional verification, delay fulfillment, cancel orders, block accounts, or report suspicious transactions to payment processors, banks, logistics providers, law enforcement, or relevant authorities.
If you initiate an unjustified chargeback, payment dispute, reversal, or false claim after receiving the product, we reserve the right to dispute the chargeback, submit evidence, suspend your account, refuse future transactions, recover costs, and pursue remedies available under law.
You agree to reimburse us for losses, fees, penalties, costs, chargeback fees, legal fees, and expenses arising from fraudulent, unauthorized, abusive, or bad-faith payment activity attributable to you.

To the fullest extent permitted by law, our total aggregate liability for any claim arising from or related to your use of the website, services, or products shall not exceed the amount actually paid by you for the specific product or order giving rise to the claim.
For food safety, allergen, contamination, foodborne illness, or product-related injury claims, MOOD FOOD shall only be liable to the extent that the claim is proven to have been directly caused by a defect, contamination, mislabeling, or unsafe condition existing in the product at the time it left our custody, and not by customer handling, storage, consumption, resale, courier handling, or other third-party acts or omissions.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for willful misconduct, gross negligence, or rights that consumers may have under mandatory consumer protection laws.
SECTION 20 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless MOOD COMMERCIAL CORP., MOOD FOOD, and our directors, officers, shareholders, employees, affiliates, partners, agents, contractors, suppliers, manufacturers, service providers, logistics partners, licensors, and representatives from and against any claim, demand, action, loss, liability, damage, penalty, fine, cost, expense, or fee, including reasonable attorneys’ fees, arising out of or related to:

b. Your violation of any law, regulation, rule, or third-party right;
